1. What is being agreed

NigelFPV provides FPV drone videography and related visual content services. The deliverables, location, date, package, price and turnaround for any project are whatever is confirmed in writing — by email, WhatsApp, quotation, invoice or booking confirmation. Those written project terms govern; these general terms fill the gaps around them.

A booking buys a creative and production service. It is not a guarantee of any commercial result — no number of views, enquiries, bookings, sales, revenue, social media performance or return on investment is promised, and none should be inferred from anything on this website.

2. Access, permissions and site conditions

You confirm that you have the authority to have filming take place at the location, and permission from whoever else needs to give it — owner, occupier, property manager, venue, event organiser or developer.

Obtaining legally required permissions from property owners, venues, residents, event organisers and local authorities is your responsibility, unless a specific permission task is expressly assigned to NigelFPV in the written booking.

Before the shoot, tell NigelFPV about anything that could materially affect it: restricted areas, fragile objects, people who must not appear on camera, confidential information or documents, security concerns, construction hazards, animals, electrical hazards, overhead wires and access restrictions.

3. Flight conditions and safety

FPV flight is affected by conditions outside the pilot's reasonable control: wind, rain, turbulence, radio or electromagnetic interference, signal loss, positioning limitations, obstacles, birds, animals, people, wires, structures, battery or equipment behaviour, and software or hardware faults.

The pilot may stop, postpone, modify or cancel a flight where, in their reasonable judgement, conditions are unsafe, unsuitable or unlawful. A creative shot, a deadline or a client instruction does not override a safety decision, and asking for one to be overridden is not a basis for a refund.

A requested shot, route, indoor pass, proximity flight or one-take sequence is subject to what the site and conditions actually allow on the day. No specific shot is guaranteed. Where conditions prevent the planned work, NigelFPV will offer a reschedule, a modified shot list or another reasonable solution.

4. Operational risk and insurance

By proceeding with a booking you acknowledge that FPV drone operation is materially different from filming with a handheld or ground-based camera, and that an unexpected flight event — signal interruption, loss of control, equipment malfunction or an environmental event — can happen despite reasonable precautions.

To the fullest extent the law allows, NigelFPV is not responsible for loss or damage arising solely from an inherent or unforeseeable operational event occurring despite reasonable care. Nothing here excludes liability that cannot lawfully be excluded, including liability for fraud or wilful misconduct.

If you need protection against property damage, event interruption or other project-specific risk, arrange your own insurance before the shoot. These terms are not a substitute for insurance, and you should not treat them as one.

5. Booking, payment and tax

Unless agreed otherwise in writing, a booking requires an advance deposit before the shoot date, and a date is only held once that deposit is received and the booking is confirmed in writing.

The balance is payable in full before final delivery. Final files, downloads, raw footage, edited deliverables and usage rights may be withheld until everything outstanding has been received.

All quoted prices are exclusive of GST and any other applicable taxes, which are added where chargeable. Bank charges and third-party transaction fees may be payable by you where they are disclosed before payment.

6. Cancellation, rescheduling and weather

FPV work depends on weather and light. If conditions are unsafe or unsuitable, the shoot is rescheduled to the earliest mutually convenient date at no extra charge.

• Reschedule with more than 48 hours' notice — the deposit carries to the new date
• Cancel within 48 hours of a confirmed shoot — the deposit is not refunded
• Weather or unsafe conditions — rescheduled free, whoever calls it

Production time, travel and availability are reserved for a project, which is what the deposit protects. Where postponement is caused by weather, site conditions, legal restrictions or anything else outside reasonable control, both sides will try in good faith to reschedule. NigelFPV is not responsible for your onward costs arising from a postponement.

7. Deliverables and revisions

You receive what the package or quotation says. Any revision allowance covers reasonable changes within the agreed creative scope. New shots, substantial re-edits, extra versions or aspect ratios, additional reels, different music, new locations or material changes to the brief are quoted separately.

Except where raw footage is expressly the deliverable of the package purchased, NigelFPV does not undertake to hand over every recorded frame, failed take, duplicate, test shot or internal production file. Where a package does supply raw footage, it is supplied as described in that package.

Delivery dates are estimates unless a firm date is expressly agreed in writing, and can move with weather, rescheduling, edit complexity, revisions, late feedback or non-payment. Download and back up what you are sent — permanent storage of project files after delivery is not guaranteed.

8. Ownership, usage and music

The usage rights you receive are those stated in your package or written booking confirmation, and they take effect on full payment. Copyright in the footage remains with NigelFPV. Rights granted do not transfer any third-party rights embedded in the work, such as music, fonts or trademarks.

Music and sound are licensed, not sold, and ownership stays with the rights holder. The delivered video must be published while that licence is active: confirm your intended publication date before delivery, and say so if it moves materially. NigelFPV is not liable for claims arising from publication outside the covered period, from extracting or reusing the music separately, or from use beyond the agreed scope. Some platforms raise automated claims even against correctly licensed music; licence documentation will be supplied to clear them.

Unless agreed otherwise in writing, NigelFPV keeps copies of captured material for business records, portfolio and promotional use.

9. Portfolio and promotional use

You grant NigelFPV permission to display, reproduce, edit, crop, excerpt and publish the resulting footage, stills and project material for portfolio, marketing and promotional purposes — on nigelfpv.com, in a showreel, in client pitches, in directory listings and on social platforms. Credit is given to your property or brand where appropriate.

If a project must stay private, request that in writing at the time of booking and get written confirmation that the restriction is accepted. A request made later may be accommodated but is not guaranteed, and restrictions on portfolio use may affect pricing.

Where people appear in the footage because of your property, event, course or activity, obtaining their consent is your responsibility. Nobody is filmed who has said they do not want to be, and NigelFPV will take reasonable care to avoid identifiable individuals when asked to.

10. Material and instructions you supply

You are responsible for ensuring that logos, photographs, music, trademarks, artwork, architectural designs, people, private information and anything else you supply or ask to be filmed may lawfully be recorded and included.

To the extent the law allows, you agree to indemnify NigelFPV against third-party claims arising from material or instructions you supplied — including claims about missing permission, privacy, copyright, trademark or property rights.

11. Confidentiality

Where you identify commercially confidential information before a shoot, NigelFPV will take reasonable steps not to disclose it. That does not by itself restrict the portfolio use described above — a no-promotional-use restriction has to be requested and confirmed in writing separately.

12. Limitation of liability

To the fullest extent the law allows, total liability arising from a project is limited to the amount actually paid for that project. NigelFPV is not liable for indirect, incidental, special or consequential loss, or for lost profit, revenue, bookings, business opportunity, reputation or data.

Nothing here excludes or limits any liability or right that cannot validly be excluded or limited under Indian law, including rights you may have as a consumer.

13. Events outside reasonable control

NigelFPV is not responsible for delay, cancellation or inability to perform caused by events reasonably beyond its control — severe weather, natural disaster, fire, accident, illness, government or airspace restrictions, public disorder, power or communications failure, equipment supply problems or site closure.

14. Governing law and disputes

These terms are governed by the laws of India. Both sides will first try in good faith to resolve any dispute by direct discussion and in writing.

Subject to any mandatory jurisdiction or consumer protection rights available to you under applicable law, the courts having competent jurisdiction at Mapusa, Goa shall have jurisdiction over disputes arising from the services, a booking, payment, deliverables or these terms.

15. Changes, severability and the whole agreement

These terms may be updated. The version that applies to a booking is the one accepted at the time of that booking, unless both sides agree otherwise in writing.

If any provision is found invalid or unenforceable, it is limited to the minimum extent necessary and the rest continues to apply. The written quotation, invoice, booking confirmation and these terms together form the agreement; where a specific written project term conflicts with these general terms, the specific term wins.
